Is there a difference between temporary employment, personnel leasing and contract work?
No, there is no difference between temporary employment, personnel leasing and contract work. These terms are often used interchangeably and refer to the employment of workers by a temporary employment agency that leases these skilled workers to other companies on a temporary basis.
At AVANTGARDE Experts, we like to use the term personnel leasing, because for us the personnel are the focus.
What is the difference between direct recruitment and temporary employment?
In the case of temporary employment, you are employed as an employee of the personnel service provider. With direct recruitment, by comparison, you are transferred by the personnel service provider to a client company and employed there as a permanent employee.

What special legal conditions apply to me as an employee in temporary employment?
As an employee in the temporary employment sector, there are special legal regulations to be observed. You receive an employment contract from your temporary employment agency and are entitled to equal treatment and, after a certain period, equal pay.
Who is the employer in temporary employment?
The temporary employment agency concludes fixed employment contracts with the temporary employees and thus assumes the role of the employer and also pays the salary in case of illness and holidays. Therefore, in the event of illness, you must inform the temporary employment agency in the first instance. The temporary worker must also coordinate with the temporary employment agency when applying for holiday.
What protection do I have as an employee in temporary employment?
Even as a temporary worker, you enjoy the same statutory protection against dismissal as in a "normal" employment relationship. Your temporary employment agency cannot simply terminate you just because it does not have a suitable assignment for you.
What is the maximum leasing period?
The maximum leasing period is a legal regulation applicable to temporary employment. It defines the maximum time for which an employee may be leased to a client company. The regulation is intended to prevent employees from remaining permanently in temporary employment.
The maximum leasing period is usually 18 months, though in exceptional cases or in the automotive industry, an extension of the leasing period is common. At the end of the maximum leasing period, the client company must decide whether to take on the temporary employee on a permanent basis or terminate the employment relationship.

What are industry surcharges?
In some sectors of temporary employment, there are wage bonuses under collective agreements if the temporary employment agency with which the worker is employed is subject to a corresponding collective agreement.
These surcharges are intended to ensure that the salary of a temporary employee is equal to that of a comparable regular employee of the client. Depending on the sector and duration of employment, staggered surcharges on the collective agreement remuneration of temporary workers are paid after they have been trained.
Is temporary employment good for me, or is it detrimental?
Although temporary employment is perceived more positively in many other countries, it has a bad reputation in Germany. However, this reputation is unfounded and there are some prejudices about temporary employment that have no basis in reality. Whether you’re just starting out in your career or are an experienced professional, temporary employment allows you to take advantage of numerous career opportunities that would otherwise have been closed to you.
How do I find a good temporary employment agency?
Not every temporary employment agency offers its applicants equally good conditions and attractive employment opportunities. The following questions will help you find the right temporary employment agency for you:
- Is there an opportunity to obtain a fixed employment contract with the temporary employment agency and is payment determined in accordance with a collective agreement? Does it pay higher wages if you have better qualifications?
- Do workers at the temporary employment agency benefit from all rights and obligations of other employees, such as protection against dismissal, paid leave, and health, accident, pension, unemployment and long-term care insurance?
- Are areas of responsibility discussed before you are assigned to a company?
- Is there a possibility of further training?
- Is there a works council that also represents the concerns and needs of temporary workers?
- Is there contact with the temporary employment agency during an assignment at a client company?
